The Supreme Court has given an important instruction regarding the fees of professional courses. The Supreme Court has directed that the fee for the entire duration of any professional course should be fixed before admission. Also the Supreme Court has said that there should be no change in the fee after the course has started. However, the Supreme Court has allowed fee modification only in very special circumstances. The Supreme Court made this clear in the case of Dr. BC Roy Engineering College v. Government of West Bengal.
Let’s know the whole matter in detail. Let us know what the Supreme Court has said about the professional course fees.
Students should know in advance how much they will be burdened due to fees.
A bench of Justice PS Narasimha and Justice Alok Aradha said that ‘fee-fixing committees should assess the potential expenditure incurred during the course and the increase in it. They should give their recommendations before the commencement of admission, so that the concerned authorities can fix the fee in advance.
The court said that a student taking admission in a professional course of four or five years should know from the outset what financial burden will be placed on him or his family.
Only this condition should change the fee.
The Supreme Court clarified that the fee can be modified if an extraordinary economic situation arises due to a change in the law or an unforeseen expense arises. However, the bench emphasized that such changes should be made only as an exception. This cannot take the place of timely and proper assessment and proper planning. The Supreme Court said that its main principle is to bring certainty through efficient regulation.
Fee fixing committees should be permanent
The Supreme Court said that especially about fee fixing committees, the Court said that they should function as a standing body, capable of estimating costs in advance, making periodic evaluations and taking decisions at appropriate times.
The decision said that their procedure should be such that the fee is fixed before the commencement of admission and should, as far as possible, cover the entire duration of the professional course.
